La moral y el derecho constitucional en el pos positivismo

Abstract

A través de una revisión histórico crítica del ius naturalismo y ius positivismo en sus diferente presentaciones, obtendremos las principales características que resultan de la relación moral derecho y sus efectos en la teoría, puestas de manifiesto en esta época pos positivista; la cual implica una nueva visión ontológica y deontológica de la ciencia jurídica, reflejada en los criterios que van a determinar la validez de la normas jurídicas, su sustento y las exigencias de racionalidad sobre juicios de moralidad objetiva que contienen esencialmente normas constitucionales que se expresan en forma de principios y no como reglas de precisa aplicación, exigiendo actitudes y aptitudes en los operadores de justicia que van desde métodos científicos clásicos y propios de la ciencia en general y del derecho en particular, como la argumentación, como medio idóneo para alcanzar, lo que para el positivismo es imposible, criterios de veracidad sobre juicios de valor, o lo que el constitucionalismo principialista denomina criterios de corrección.
