Estudio De Las Generalidades Y Perfeccionamiento Del Contrato En Derecho Comparado

Abstract

El estudio del contrato en Derecho Comparado es importante porque si bien algunas disposiciones legales de los distintos países son iguales, en otras son total opuestas o simplemente no son reguladas por la ley. Cada una de las legislaciones analizadas nos ha permitido conocer que aunque los Estados tengan normas jurídicas en común, la forma en que interpretan las mismas no siempre es igual. Por ello consideramos en la medida de que sea posible conocer la forma de actuar de los legisladores y jueces en general, para darle el sentido correcto al momento de aplicar una ley. Encontramos grandes diferencias en las legislaciones estudiadas, en uno de los temas que podemos considerar de los más importantes, porque son los que dan la existencia al contrato. El Cc español establece tres elementos esenciales, consentimiento, objeto y causa, el Cc francés aparte de estos tres reglamenta uno más, la forma, mientras que el CCF mexicano dispone dos, consentimiento y objeto.
