Abstract

O Novo Código de Processo Civil Brasileiro trouxe em seu artigo 942, novel técnica de julgamento, que consiste na sua continuidade, em caso de resultado não unânime, independentemente de qualquer provocação das partes, em substituição aos extintos embargos infringentes. Trata-se de novidade polêmica, objeto de discussão entre os processualistas, especialmente considerando a sempre desejada razoável duração do processo. Neste esteio, a presente abordagem busca esclarecer o dispositivo, comparando-o com o recurso eliminado, refletindo sobre suas possíveis consequências.
