A Disponibilidade De Direitos Fundamentais Sob A ÓTica Da Teoria De Robert Alexy

Abstract

Este artigo visa uma análise sobre a dimensão da disponibilidade dos direitos fundamentais, baseada principalmente na teoria principiológica desenvolvida por Robert Alexy, para ao final oferecer um conceito de disposição (ou autolimitação) de direitos fundamentais. Para isso, buscaremos defender a construção metodológica alexyana de relevantes críticas contemporâneas. Em seguida, a pesquisa irá expor a necessidade de superação do paradigma de indisponibilidade de direitos fundamentais, procedendo a uma interpretação de disponibilidade prima facie e seus elementos de caracterização, tudo sob uma ótica enriquecida pelos trabalhos de Letícia de Campos Velho Martel.
