El Debido Proceso Y El Derecho Penal

Abstract

El debido proceso de acuerdo a la Constitución de la República del Ecuador, y como lo señala Couture, es una garantía constitucional que consiste en asegurar a los individuos la necesidad de ser escuchados en el proceso que se juzga su conducta, con oportunidades para la exposición y prueba de sus derechos, de gran importancia en el derecho penal en especial en los procedimientos aplicados en el actual Código Orgánico Integral Penal. Considero relevante hacer un estudio de la Constitución y nuestra normativa en materia penal, ya que así podemos darnos cuenta de la importancia que tiene esta garantía básica del derecho, en la que se señala varios principios tales como el principio de inocencia, de legalidad, de favorabilidad, de proporcionalidad así como el derecho de las personas a la defensa.
