Anã Lisis Constitucional Del Apremio Personal Contra Los Adultos Mayores Por Su Responsabilidad Subsidiaria En El Derecho A Alimentos

Abstract

Desde el año 2009 en el Ecuador se suscitaron muchos atropellos inconstitucionales con la Ley Reformatoria al Título V del Libro II del Código de la Niñez y Adolescencia, pues los jueces dictaron apremio personal para los abuelos, mayores de 65 años, debido a que sus hijos no cumplían sus obligaciones en su calidad de alimentantes. Todo esto fue muy criticado por la ciudadanía y provocó que se plantee un proyecto de Reforma ante la Asamblea Nacional, la misma que actualmente ya pasó al segundo debate, y en donde se está proponiendo que no exista el apremio personal para los obligados subsidiarios mayores de 65 años de edad, puesto que el apremio personal a un Adulto Mayor se torna inconstitucional y viola el derecho de una persona que pertenece al grupo vulnerable de la sociedad, tal como lo dice la Constitución y los Tratados Internacionales.
