Propriedade Privada E Funã‡Ãƒo Social Da Propriedade

Abstract

A propriedade privada será tratada diante da perspectiva da função social. O direito de propriedade é resguardado pelo artigo 5º da Constituição Federal Brasileira como direito fundamental. Além disso, ele é previsto por inúmeros artigos ao longo do texto do Código Civil de 2002. Entretanto, a Constituição Federal Brasileira também prevê no artigo 5º, que a propriedade atenderá a sua função social. Sendo assim, o presente artigo descreve os aspectos históricos evolutivos tanto do direito de propriedade como da função social, bem como, ressalta a sua importância para a coabitação e para a sociedade e sua aplicabilidade nos dias atuais.
