O Poder Dos Direitos Fundamentais No Estado Constitucional: Algumas Consideraã‡Ã•Es

Abstract

O Estado Constitucional é aquele que encontra seu fundamento na Constituição escrita, que, por sua vez, norteia a atividade estatal estabelecendo a separação de poderes e a democracia como forma de governo, além de consagrar os direitos pessoais, políticos e sociais dos homens. Nesse sentido, o Estado Constitucional é mais que o Estado de Direito por congregar o poder do demos e os direitos fundamentais. Esses direitos fundamentais desempenham papel excepcional na conjuntura política do Estado Constitucional, posto que legitimam a atividade estatal e limitam o seu poder. É um Estado que, ademais, deve priorizar e respeitar a condição da pessoa e sua dignidade e promover os direitos fundamentais, individuais ou coletivos.
