Abstract

No Brasil, durante a menoridade, os filhos estão sujeitos ao poder familiar dos pais, o qual consiste, entre outros deveres e direitos, na criação, na educação e no exercício da guarda. Desse modo, os pais são responsáveis pelo atos, lícitos e ilícitos, praticados pelos filhos durante o exercício do poder familiar. No entanto, a regra contém exceções, traduzindo o objetivo desta pesquisa: investigar a responsabilidade civil dos genitores em razão de atos ilícitos praticados por seus filhos.
