Requisitos Del Requerimiento De Pago Extrajudicial Con Efectos No Enervatorios En La Acción De Desahucio Por Falta De Pago

Abstract

El artículo 22.4 de la Ley de Enjuiciamiento Civil establece la posibilidad de enervar la acción de desahucio por falta de pago, siempre que por parte del arrendatario, en el plazo que se le fije al ser requerido en el proceso de desahucio incoado, pague al actor o ponga a disposición del Tribunal o notarialmente, el importe de las cantidades reclamadas en la demanda y el de las que adeude. El arrendador puede evitar dicha enervación si requiere de pago al arrendatario, por cualquier medio fehaciente, con al menos treinta días a la presentación de la demanda y el pago no se hubiese efectuado al tiempo de dicha presentación. Los requisitos de dicho requerimiento han sido objeto de diferente interpretación por parte de las distintas Audiencias Provinciales. Por la Sala de lo Civil del Tribunal Supremo se ha puesto fin a dicha polémica, interpretando y dictando doctrina respecto a la forma y requisitos de dicho requerimiento.
