Da Modernidade À Pós-Modernidade: A Exigência De Uma Nova Forma De Hermenêutica Constitucional

Abstract

O presente trabalho objetiva analisar a virada de paradigmas ocorrida em decorrência da transição da modernidade para a pós-modernidade, tendo como ponto de partida a obra de Eduardo Bittar, 'O Direito na pós-modernidade'. Observar-se-á as incertezas, medo e insegurança geradas nesta fase, passando pela noção de Estado Social e pela dicotomia entre o público/privado, bem como os novos valores frente à fragmentação da vida. A partir disto, buscar-se-á apresentar a necessidade de uma nova forma de hermenêutica constitucional, de ordem principiológica, jurisprudencial e de fundamentos, especialmente em vista da atual insuficiência de codificações e códigos de opção.
