Abstract

A Era Lochner é um período na história legal americana que, durante 1905 a 1937, a Suprema Corte dos Estados Unidos tendeu a invalidar a regulação econômica acerca do estabelecimento de certas condições de trabalho ou salários, bem como a limitação da jornada. Este trabalho tem por objetivo analisar se, durante esta Era, a Suprema Corte manteve um escrutínio coerente acerca dos julgamentos proferidos, esboçando os casos excepcionais mais significantes que compuseram a posição minoritária da Corte.
