Abstract

En este artículo se abordará el derecho fundamental a la educación de la primera infancia y sus consecuencias para los municipios, principalmente a causa de las frecuentes alegaciones de limitaciones financieras. En un primero momento examinaremos la legislación pertinente al tema. Posteriormente, abordaremos el tema de la limitación de hecho y financiera a la protección de los derechos sociales. Por último, examinaremos algunas de las decisiones más relevantes sobre la educación de la primera infancia en las cortes más importantes del derecho brasileño: el Supremo Tribunal Federal y el Superior Tribunal de Justicia.
