Abstract

O trabalho tem como objetivo geral analisar a (im)possibilidade da prestação alimentar cumulativa entre o pai biológico e o socioafetivo. A questão é emergente no Direito brasileiro, tornando-se polêmica com a decisão veiculada no Processo nº 064.12.016352-0, da Comarca de São José, Santa Catarina. Em virtude do segredo de justiça imposto ao caso, não se teve acesso a todas as informações, assim a pesquisa almeja refletir a partir das informações obtidas, em especial dos dados da decisão liminar, para ilustrar uma possibilidade jurídica que poderá se projetar, doravante, em outros casos. Deste modo, resta explicitada a problemática do trabalho, qual seja: é possível impor o dever alimentar cumulativo entre o pai biológico e o socioafetivo? Para a realização da pesquisa foi utilizado o método indutivo e amplo rol de referências.
