Abstract

La noción tradicional de la eficiencia como criterio de Justicia desde la maximización de la riqueza no es sostenible en algunos puntos importantes del Derecho Penal. Sobre todo en aquellas situaciones donde se pone en duda la pertinencia de la persona humana y su dignidad. Es allí, en estas situaciones, que el Derecho Penal no puede perder su densidad, su relevancia, bajo el argumento hábil de aceptar todas las instrumentalizaciones, ya sea como resultado de un individualismo egoísta o de un relativismo estéril.
