La Oralidad Como Facilitadora De Los Principios Del Proceso Penal

Abstract

La oralidad constituye el más importante de los principios que informan el proceso penal. A través de ella se ponen en práctica los demás principios que orientan el proceso en todas sus etapas, entre ellos se encuentran el de contradicción, igualdad, inmediación, entre otros. En la actualidad es un principio prevaleciente en la mayoría de los ordenamientos procesales modernos. A pesar de que es esencialmente técnico, es necesario tener en cuenta su incidencia en el cumplimiento de las garantías y derechos de los acusados. Su exigencia está recogida en los principales instrumentos internacionales que protegen los derechos humanos, como medio de garantía de los mismos, por lo que se incardina con principios esencialmente políticos. El proceso penal cubano está marcado por el signo de la oralidad, la cual se logra mediante la práctica de las pruebas en el juicio oral ante los ojos del juzgador.
