Derechos De Los Productores De Fonogramas

Abstract

La expresión derechos conexos no goza del aprecio de la doctrina y su contenido es impreciso, pero se ha impuesto por su uso corriente. Se trata de derechos concedidos en un número de países para proteger los intereses de los artistas intérpretes o ejecutantes, de los productores de fonogramas y organismos de radiodifusión en relación con sus actividades referentes a la utilización pública de obras de autores, toda clase de representaciones de artistas o trasmisión al público de acontecimientos, información y sonidos o imágenes. Se le conoce como derechos vecinos o derechos afines. Se trata de derechos independientes, plenamente autónomos, que no están en conflicto y que por lo contrario es semejante al derecho de autor. En el texto de la Convención de Roma sobre los derechos de los artistas intérpretes o ejecutantes, los productores de fonogramas y los organismos de radiodifusión, se enfrenta en 3 artículos, la fricción entre estos dos derechos y la necesidad de procurar su coexistencia pacífica. Nuestro estudio trata de exponer algunas consideraciones sobre los derechos de los productores de fonogramas.
