¿Es Posible Fundamentar La Eutanasia Voluntaria En Cuba? Un Acercamiento Jurídico Al Fenómeno

Abstract

La eutanasia voluntaria es un fenómeno singular, en el cual se unen antigüedad y actualidad. Sus implicaciones sociales, éticas y jurídicas, la hacen invulnerable a la parcialidad de los enfoques, por tanto, sólo desde la multidisiciplinariedad, puede llegarse a ella. Sus relaciones con el Derecho son particularmente estrechas y contradictorias, al punto de que, aún cuando la moral social la rechace mayoritariamente, los ordenamientos jurídicos pueden permitir su legitimación. Un caso semejante es el apreciable en el ordenamiento legal cubano, en el cual la redacción literal de muchos de sus postulados deja entrever una interpretación favorable a su legitimación, o, en cualquier caso, a su no penalización.
