Abstract

Constituye objetivo de nuestro trabajo abordar los distintos estadíos de la embriaguez alcohólica e ilustrar cual de ellos tiene trascedencia para el Derecho penal y la criminología porque inciden en la capacidad volitiva del sujeto activo comisor de todo delito, las consecuencias jurídico penales que de ello se derivan y mucho más importante demostrar cuando se aplica según la preceptiva legal sustantiva y cuando no, amén de las consideraciones doctrinales en cuanto a ello y en cuanto a la teoría generalmente aceptada por todas las legislaciones penales incluyendo la nuestra de la actio libere in causa para determinar la capacidad de culpabilidad o no del sujeto al momento de la comisión del hecho delictivo, cuestión trascedental en el orden jurídico penal por guardar estrecha relación con la imputabilidad del sujeto y por ello con la aplicación .
