A Jornada De Trabalho No Direito Brasileiro

Abstract

O sistema de duração da jornada laboral foi objeto de preocupação do legislador Constituinte nos incisos XIII a XVII do art. 7º, sendo complementado pelos comandos dispostos no art. 57 e seguintes da Consolidação das Leis Trabalhistas. Pretende-se, nessa pequena investigação, discorrer inicialmente sobre a evolução histórica da jornada de trabalho e sua regulamentação pelos Estados Modernos, incluindo-se o Brasil. Posteriormente, se buscará desenvolver os fundamentos intrinsecamente atrelados a este instituto na Constituição Federal de 1988 e na legislação trabalhista vigente, dando ênfase ao art. 62 da CLT que excluem alguns empregados da proteção normal da jornada de trabalho e ao fenômeno da flexibilização que permitiu a tutela sindical do número de horas trabalhadas em sistema de revezamento, para diminuir ou acrescer a jornada, desde que respeitada a duração máxima de 44 horas semanais.
