Abstract

Na era digital, quando se celebra a quebra de fronteiras promovida pela Internet, as marcas tornaram-se valiosos bens intangíveis das corporações. Por sua qualidade imaterial, acabam sendo apropriadas por diversos agentes, sobretudo no campo das artes. Ato polêmico em tramitação no congresso norte-americano prevê transformar marcas intangíveis em propriedades reais, fazendo recair sobre elas as mesmas leis que valem para as propriedades físicas. Se aprovado, ele representa séria ameaça ao direito de expressão de indivíduos, mas também às próprias corporações.
