Abstract

O novo marco legal das licitações públicas, Lei Federal n. 14.133/2021 (Nova Lei de Licitações e Contratos – NLLC), trouxe importantes impactos em todos os níveis federativos. Esta pesquisa, a partir do paradigma da Design Science Research (DSR) e com uma proposta sociotécnica, analisou o impacto da escolha e uso de Sistemas Informatizados (SIs) no processo licitatório (e-procurement). Optou-se por metodologia mista (qualitativa e quantitativa) para compreender esse fenômeno e explicar as variáveis e suas relações na escolha do tipo de SI (próprio, terceirizado ou do Governo Federal) adotado por parte de estados e municípios, bem como seus resultados. A análise mostra as dificuldades de adequação aos comandos da NLLC, merecendo menção a melhor transparência com o advento das publicações das licitações no Portal Nacional de Contratações Públicas, embora precise de aprimoramentos.
