Flexibilidade e fragilidade nas contratações temporárias do setor público

Abstract

Um levantamento jurisprudencial exploratório das decisões do Tribunal de Justiça de São Paulo (TJ-SP) entre julho de 2019 e julho de 2020 revela as principais controvérsias jurídicas atuais sobre as contratações temporárias de agentes públicos estaduais e municipais (Constituição Federal, art. 37, IX). O documento mostra a tensão gerada pela diferença de direitos entre os servidores estatutários e celetistas e os agentes temporários e sugere que a redução da fragilidade destes deve ser objetivo da reforma administrativa. Mostra também que, embora seja sensível à necessidade de existirem espaços de flexibilidade na gestão dos recursos humanos públicos, o Judiciário, atento ao regime constitucional, empenha-se em proteger o espaço dos cargos efetivos, que exigem concurso público, contra a expansão descontrolada das contratações temporárias.
