Transparência ativa no Judiciário: um estudo dos portais eletrônicos dos Tribunais de Justiça

Abstract

A transparência das ações governamentais é fundamental para o fortalecimento da conexão entre Estado e sociedade, entretanto estudos realizados nos poderes das três esferas de governo da federação brasileira revelam práticas formalísticas de transparência. Esse formalismo evidenciado e as características do Poder Judiciário, que afrontam a ampla divulgação de informações, instigaram nossa análise sobre como os Tribunais de Justiça estaduais cumprem as exigências de transparência previstas na legislação. Os resultados obtidos na pesquisa demonstram que o Judiciário estadual não segue adequadamente as normas de transparência, o que indica um déficit democrático nesse poder.
