Breve Análise Da Legislação Das Políticas Públicas De Empregabilidade Para Pessoas Com Deficiência

Abstract

O presente artigo tem como objetivo descrever e analisar as ações das políticas públicas de empregabilidade para as pessoas com deficiência (PcDs) existentes no Brasil atualmente. Dentre os programas de emprego e renda, cabe destaque para a Lei no 8.213/91 (BRASIL, 1991), conhecida como Lei de Reserva de Cotas, que estabelece fração percentual mínima de contratação de pessoas com deficiência para empre­sas com mais de 100 empregados, assim como a Lei nº 7.853 (BRASIL, 1989), que estabelece normas gerais dos direitos das pessoas com deficiência e, em especial, normas relativas à sua acessibilidade. Essas leis se constituem em políticas públicas no processo de inclusão da diversidade no ambiente de trabalho e servirão como parâmetro avaliativo da análise proposta pela pesquisa. ABSTRACT This article aims to describe and analyze the actions of public policies for employability for people with disabilities, actually in Brazil. Among the programs of employment and income, particularly Law n. 8.213/91 (BRAZIL, 1991), known as Law of Quotas, which establishes minimum percentage fraction of hiring people with disabilities for companies with more than 100 employees, as well as the Law n. 7.853 (BRAZIL, 1989) laying down general rules on rights of people with disabilities and, in particular, standards on accessibility. These laws are public policies in the process of inclusion of diversity in the workplace and will serve as a parameter let analysis proposed by the search.
