Abstract

O cumprimento adequado das funções estatais depende da realização de reformas na administração pública que alterem as leis e, frequentemente, a Constituição. Nos quadros da organização administrativa, a empresa estatal é um instrumento para a consecução de finalidades governamentais, inclusive a prestação de serviços públicos. O presente artigo avalia como a jurisprudência do Supremo Tribunal Federal vem dificultando o uso de empresas estatais para a prestação de serviços públicos com a sua autarquização. ABSTRACT The proper discharge of state functions depends on reforms in public administration to amend the laws, and often the Constitution. In the tables of the administrative organization, a state-owned enterprise is an instrument for the achievement of governmental purposes, including the provision of public utilities. This article examines how the ruling of the Brazil´s Federal Supreme Court has strained the use of state-owned enterprises for the provision of public utilities.
