O lugar das terras indígenas no federalismo brasileiro

Abstract

A política de demarcação de terras indígenas é um dos mais importantes componentes da complexa relação entre o governo e os povos indígenas no Brasil. O artigo analisa especificamente o reconhecimento legal dos direitos territoriais indígenas no curso de formação da federação brasileira. Começando com uma discussão teórica sobre federalismo e sua dimensão étnica, o artigo procura explicar e analisar as instituições que foram criadas e implementadas até a Constituição de 1988. Ele também traça as mudanças recentes na política federal de demarcação de terras indígenas no Brasil. Apesar dos avanços na legislação e na demarcação em terras indígenas nas últimas décadas, a concepção do sistema federal no Brasil nunca incluiu as heterogeneidades indígenas tanto em seu quadro institucional, como nos processos recentes de descentralização. Esta omissão é evidente, embora exista potencial teórico para o regime federal incluir as diversidades étnicas.
