Avrupa Birligi Sosyal Hukukunda Ayrimcilikla Mücadele Kapsaminda Kadin Erkek Esitligi

Abstract

Genel olarak bakildiginda, calisma yasamindan insan haklari ve azinlik rejimlerine kadar oldukca genis bir uygulama alanina yayilan ayrimcilikla mücadele politikalari AB’nin kadin-erkek esitligine yaklasimi acisindan da belirleyici bir konumda oldugu görülmektedir. Zira Avrupa bütünlesmesinin erken asamalarinda büyük ölcüde ekonomik kaygilarla ele alinmis olan kadin-erkek esitligi konusu, zamanla diger faktörlerin de etkisiyle giderek ön plana cikmis, özellikle 1970’li yillarin ortalarindan itibaren konunun ekonomik boyutuna sosyal boyutu, hatta insan haklari boyutu da eklenmistir. Dolayisiyla AB’de kadin-erkek esitligine iliskin olup büyük ölcüde is hukuku kapsaminda yer alan yasal düzenlemeler ayni zamanda Birligin ayrimcilikla mücadele politikasinin da önemli bir kismini olusturmaktadir. Calisma ayrimciligin kavramsal cercevesi ve muhtelif bicimlerinden hareketle AB sosyal hukukundaki ilgili düzenlemeleri ortaya koymayi amaclamaktadir.
