40. Yilinda Ingiltere’de Yerel Yönetim Ombudsmani

Abstract

Ombudsmanlik sistemi uygulandýðý ülkelerde yapýsal ve iþleyiþsel olarak birbirinden farklý özellikler göstermektedir. Ombudsmanlarýn, ulusal, bölgesel ya da il düzeyinde coðrafi düzlemde örgütlenenleri olduðu gibi herhangi bir coðrafi bölge gözetmeksizin sadece belirli ihtisas alanlarýnda örgütlenenleri de bulunmaktadýr. Kökeni onsekizinci yüzyýlýn baþlarýna dayanan ombudsmanlýk, Ýngiltere’de Parlamento Ombudsmaný olarak 1967 yýlýndan itibaren uygulanmaktadýr. Ülkede diðer ombudsmanlarýn çalýþma alanlarý çoðunlukla ihtisas alanlarýna göre biçimlenmiþ olup, bu araþtýrmanýn konusu olan Yerel Yönetim Ombudsmaný, yerel yönetimlerin görev alanýna giren konularý inceleme yetkisine sahiptir. 1974 yýlýnda kurulan Yerel Yönetim Ombudsmanlýðý, kurulduðu yýldan günümüze tanýnma düzeyi, görev ve yetki alanlarý, uygulamalarý ve yaptýrýmlarý ile tartýþýlmýþ ve zaman zaman sert eleþtirilere uðramýþtýr. Bu eleþtirilere, yapýlan memnuniyet araþtýrmalarýnýn sonuçlarýna ve kurumdan hizmet almak için baþvuranlarýn geri bildirimlerine baðlý olarak kimi iþleyiþ deðiþiklikleri yapýlmýþtýr. Günümüzde Ýngiltere Yerel Yönetim Ombudsmaný çeþitli boyutlarýyla yeniden tartýþma konusudur. 2012 yýlýnda hazýrlanan dönüþüm planý çerçevesinde bir dizi deðiþiklik yapýlmasýna iliþkin süreç devam etmektedir. Ýngiltere’deki ombudsmanlýk sistemi içerisinde önemli bir yeri olan Yerel Yönetim Ombudsmaný, kýrk yýllýk deneyimi, geçirdiði dönüþüm ve bu dönüþüme iliþkin gerekçeleriyle ve baþvurucularýn þikayetlerini ele alýþ biçimiyle, Türkiye için örnek olabilecek negatif ve pozitif dersler içermektedir.
