Should we regulate any aspects of wireless?

Abstract

The following article starts with an overview of the regulatory framework for the telecommunications sector in Germany with special focus on the institutional set up for the market analysis and the relationship between the Cartel Office (the NCA) and RegTP (the German NRA for Telecommunications and Postal Markets). Concentrating on the current German framework, the article explains that there is already a strong link between sector-specific regulatory law and general competition law, since for market analysis the same principles and procedures have to be applied by RegTP when analyzing telecommunications markets as by the Cartel Office, when analyzing other markets. This is shown with the example of mobile market analysis, and empirical evidence is given that demonstrates the correctness of RegTP's analysis of an effectively competitive German mobile market. Following a comparison between fixed and mobile networks, the article ends with an assessment of whether general competition law instruments could be sufficient to maintain competition in mobile markets before drawing conclusions.
