Abstract

(VF)L’objectif de cet article est de contribuer à une meilleure compréhension des décisions des acteurs du processus de prévention des difficultés, en se fondant sur l’analyse de données qualitatives issues de l’étude exploratoire d’un cas de conciliation et de sauvegarde. Les cas sont analysés au regard d’un cadre d’interprétation reposant sur deux dimensions, l’une juridique et l’autre financière, qui se complètent. La principale contribution du travail réside dans la formulation de quatre propositions théoriques destinées à améliorer ce cadre d’interprétation et à identifier un certain nombre de facteurs clés de succès ou d’échec du processus de prévention des difficultés.(VA)The aim of this article is to contribute to a better understanding of claimholders decisions during the preventive bankruptcy process. The research work is conducted using qualitative analysis of case study data about exploratory conciliation and safeguarding of assets. The cases are analyzed within a conceptual framework based on both legal and financial dimensions. The main contribution of the research consists of four theoretical propositions dedicated to improving this conceptual framework, and to identifying some key success (or failure) drivers of the preventive bankruptcy process.
