Comentariu De Speţă – Simulaţie Prin Deghizare A Unui Act Juridic Civil

Abstract

Our case-analysis concerns the situation of simulation by disguise of a civil legal act. From a legal point of view, the essence of this case is the existence of a final and irrevocable court decision for solving a case concerning a land registration suit. Due to this court decision having the power of res judicata, the assertion of the claimant that in reality he did not want to conclude a pre sale contract, but a donation contract exclusively to the benefit of his son, is inadmissible and without any legal effect.
