Abstract

C’est à l’exactitude de la délimitation entre le préjudice non patrimonial, d’un coté et le préjudice patrimonial, de l’autre coté, que dépend la grande division des droits en droits avec caractère patrimonial et droits avec caractère extrapatrimonial. Le préjudice moral est celui qui n’est pas exprimé par une perte d’argent, puisqu’il touche à un droit extrapatrimonial et non pas au patrimoine, le dommage moral étant celui qui touche aux intérêts extrapatrimoniaux et non économiques de la personne, portant préjudice aux ainsi nommés droits de la personnalité. C’est bien dans ce contexte-là qu’on peut remarquer le fait que le préjudice moral vise la lésion portée aux intérêts des personnes, concrétisée dans des souffrances physiques, mais aussi dans des troubles psychologiques éprouvées par la victime.
