Смарт-Контракты И Блокчейн: Вызовы Для Договорного Права В Республике Узбекистан

Abstract

Статья посвящена исследованию правовых вызовов, возникающих в связи с внедрением технологий блокчейн и смарт-контрактов в сферу договорного права Республики Узбекистан. Автор рассматривает сущность смарт-контрактов, их технологические особенности и отличия от традиционных договоров, а также анализирует действующую нормативно-правовую базу Узбекистана, касающуюся блокчейн-технологий. Особое внимание уделяется взаимодействию смарт-контрактов с основополагающими принципами гражданского права — автономией воли сторон, добросовестностью, возможностью пересмотра условий договора, а также вопросам правоприменительной практики. Выявлены основные регуляторные вызовы, в том числе неопределённость правового статуса смарт-контрактов, отсутствие механизмов защиты прав потребителей, вопросы AML/CFT, а также коллизии юрисдикций в транснациональной блокчейн-среде. В заключение предлагаются направления развития договорного права и рекомендации по адаптации законодательства Республики Узбекистан к цифровой экономике.
