Mehnatga Oid Munosabatlarda Kamsitish Uchun Huquqiy Javobgarlik Masalalari

Abstract

Ushbu ilmiy maqolada xalqaro tashkilotlar va dunyoning rivojlangan mamlakatlarning mehnat munosabatlarida kamsitishga qarshi qabul qilingan normativ-huquqiy hujjatlari hamda huquqbuzarlik uchun javobgarlik asoslari oʻrganiladi. Xalqaro huquq subyektlari tomonidan qabul qilingan strategiyalar va amaliyotlarni tahlil qilib global ishchi kuchida teng imkoniyatlar va adolatli munosabatni yaratish masalasi haqida maʼlumot beriladi. Maqolada kamsitishlarga qarshi kurashda samarali yondashuvlar, qonunchilik asoslari, ijro mexanizmlari va ish beruvchilar amaliyoti koʻrib chiqiladi. Dunyoni rivojlangan davlatlar kamsitishlarga qarshi kurashish va ish joyida teng munosabatni targʻib qilish boʻyicha muhim chora-tadbirlar va ular negizida jazo choralari belgilagan. Har bir davlatning yondashuvi ularning huquqiy mexanizmi va qonun manbalariga jazo choralari farq qilishi mumkin. Mehnat munosabatlarida kamsitishning oldini olishning asosiy jihatlaridan biri bu keng qamrovli qonunchilikning mavjudligi va uning samarali ishlashi hisoblanadi. Rivojlangan mamlakatlarda, odatda, irqi, etnik kelib chiqishi, jinsi, yoshi, nogironligi va boshqalar kabi turli xil himoyalangan xususiyatlar asosida shaxslarni kamsitishdan himoya qilish uchun mustahkam huquqiy asos va uning ijro mexanizmi yaratilgan.
