Abstract

The research analyzes the legal implications of instigation to suicide in the Ecuadorian educational environment, based on two cases from 2023: one at the “Herlinda Toral” Educational Unit in Cuenca and another at the “Mejía” School in Quito. The possible criminal responsibility of teachers and peers in students' decisions to take their own lives is examined, using a qualitative approach and case analysis according to the Código Orgánico Integral Penal. The findings highlight psychological mistreatment by teachers in Cuenca and prolonged harassment by peers in Quito as determinant factors. The urgency of school policies to prevent bullying and protect students is emphasized
