Abstract

Производството по несъстоятелност е съвкупност от процесуални действия, предприемани последователно във времето, в резултат на което се обособяват и относително самостоятелни етапи (фази) от цялостната съдебна процедура. На тази основа, в настоящото проучване са подложени на анализ обявяването на длъжника в несъстоятелност и осребряването на неговото имущество. От теоретично и практическо значение са проблемите относно предпоставките за преминаването към тази фаза и принципите на законодателната уредба, които са вид гаранция за правата на кредиторите и длъжника.
