Implementierungsstand von und Sensibilisierung für Compliance-Management in KMUs

Abstract

Compliance als unternehmerische Aufgabe und Funktion hat in den letzten Jahren deutlich an Stellenwert gewonnen und zwingt Unternehmen aller Größen zum Handeln. Daher hat die Implementierung von Compliance-Management-Systemen (CMS) in der Praxis zugenommen, nicht zuletzt auch durch die Zunahme der öffentlichen Aufmerksamkeit und verstärkter Regularien. Diese Thematik betrifft nicht mehr nur kapitalmarktorientierte Großunternehmen, sondern fordert auch von kleinen und mittleren Unternehmen (KMU) einen Handlungsbedarf. Die aktuelle Studie basiert auf einer Umfrage, die unter den Stelleninhabern von Top-Management Positionen und Compliance-Verantwortlichen durchgeführt wurde. Die Ergebnisse zeigen, dass die Bedeutsamkeit von CMS in KMUs zwar als hoch eingeschätzt wird, aber die betriebliche Praxis dies nicht in Form einer Systemimplementierung widerspiegelt. Wenn Geschäftsführungen bzw. Vorstände in KMUs dem Compliance-Management eine hohe Relevanz beimessen, dann hat dies Auswirkungen auf die Zufriedenheit aller mit dem Compliance-Management. Dennoch besteht ein Nachholbedarf bei der Implementierung von Compliance-Prozessen und -Strukturen in KMUs. / Compliance as a corporate task and function has become much more important in recent years and is forcing companies of all sizes to act. Therefore, the implementation of compliance management systems (CMS) has also increased in practice, not least due to 4the increase in public attention and tighter regulations. This issue no longer only affects large capital market-oriented companies, but also forces small and medium-sized enterprises (SMEs) to take action. The current study is based on a survey conducted among top management positions and compliance officers. The results show that although the importance of CMS in SMEs is rated as high, the operational practice does not reflect this in the form of a system implementation. If the management or the board of directors in SMEs attach a high relevance to compliance management, then this has an impact on satisfaction with compliance management. Nevertheless, there is a need to catch up in the implementation of compliance processes and structures in SMEs.
