Abstract

This article reviews the birth of international law in two parts. The first recalls the origins of the concept in history, then develops the first construction of the implementation of international law after the 14/18 war with the creation of structures such as the League of Nations, the War Reparations Commission and, of course, the establishment of the first form of international justice. The aim was to make war illegal and, more generally, to ensure that the law would always prevail over the use of force. The inter-war period saw the failure of this first attempt, leading to the second phase, that of the post-1945 period, with the creation of the UN and its structures, which, in theory, should have been more effective. The Cold War put this ambition on hold, only to be revived with the end of the Cold War in Europe on 9 November 1989 and the fall of the Berlin Wall. The period that was to begin, and which is still underway, will see a constant confrontation between attempts to implement this new international law and the resistance that continues to this day with the new wars that punctuate our now multipolar world.
