懲罰性賠償對專利故意侵權的威懾機制研究——基於9473份裁判文書的實證分析

Abstract

威懾理論為理解懲罰性賠償的制度功能提供了分析框架，但懲罰性賠償對專利故意侵權的具體威懾機制尚缺乏系統的實證檢驗。本研究基於威懾理論，構建包含嚴厲性、確定性、及時性三個客觀維度及主觀感知中介條件的威懾機制模型，運用分佈滯後模型對2021至2025年間9473份專利侵權裁判文書進行實證分析。研究發現：第一，提高平均懲罰性賠償額或縮短平均維權用時的威懾效果極其有限；第二，懲罰性賠償支持率的提高能夠形成快速且有效的威懾；第三，大額懲罰性賠償案件能夠以其示範性作用產生滯後威懾。基於上述發現，研究總結以下啟示：應當減少懲罰性賠償的適用障礙，同時加強典型案例的塑造與宣傳，並避免片面追求高額判賠與快速審結。
