群體性網路暴力引發自殺的責任分配問題與刑事歸責路徑研究

Abstract

隨著社交媒體的廣泛使用,中國互聯網空間中群體性網路暴力事件呈持續高發態勢。此類現象具有鏈式傳播、匿名擴散與表達疊加的特徵,易使受害者陷入長期的心理壓力與社會性羞辱,極端情況下可能誘發自殺等嚴重後果。近年來,司法實踐中多起與網路暴力相關的死亡事件引起社會廣泛關注,但在刑法適用上,因果關係的認定、責任主體的區分以及平臺注意義務的界定仍存在明顯困境。本文以“結構化因果鏈條”理論為分析框架,認為自殺行為應被理解為外部刺激、個體脆弱性與直接誘因交織作用的結果,其中群體性網路暴力在外因層面具有實質促成作用。為回應刑法適用的現實難題,文章嘗試在理論上構建“累積性因果力”判斷模型,結合《中華人民共和國刑法》第25條關於共同犯罪、第233條關於過失致人死亡罪以及第232條關於教唆、幫助自殺等條款,探討多主體線上行為對結果發生的法律意義。同時,本文將網路暴力中的參與主體劃分為主導型行為人、擴散型參與者與網路平臺三類,並分別分析其在合成性危害中的行為貢獻度與可歸責性。針對平臺方的角色,本文結合《網路安全法》第47條、第48條及《個人資訊保護法》第69條,論證其在內容審核、演算法推薦及風險防控中的注意義務邊界。在侮辱罪、誹謗罪、共同犯罪與過失致死罪等傳統罪名難以充分適用的情形下,本文提出引入功能性聯繫理論、完善責任分層體系,並明確平臺方的刑事注意義務標準。研究旨在推動我國網路暴力治理從個體化責任識別向結構化風險應對轉型,為刑法在數位社會的生命保護功能提供可行的制度支撐與理論參考。
