新就業形態中快遞員與平臺用工關係法律性質的再審視——基於《勞動合同法》第十四條的分析

Abstract

隨著平臺經濟的快速發展,新就業形態下的用工結構日益去雇主化、去契約化,快遞員等靈活就業群體的勞動關係認定面臨實質性挑戰。《勞動合同法》第十四條原本為缺乏書面合同的勞動者提供了“事實勞動關係”的救濟通道,但在平臺控制方式高度技術化、勞動指令呈現去中心化趨勢的背景下,該條款的適用遭遇“用工隸屬性”判斷的現實困境。本文以快遞行業為切入點,從新就業形態下用工模式的變遷出發,系統梳理快遞員與平臺之間勞動關係的法律適用現狀,剖析第十四條條文結構及司法適用邏輯,揭示勞動關係認定在實踐中的標準多元、判例分歧與制度空白。在此基礎上,文章提出,應通過擴張解釋勞動關係內涵、構建“准勞動關係”制度路徑、強化行政資料監管與平臺披露義務,實現在數位化背景下對勞動者權利的實質性保護。本文意在推動傳統勞動法范式向更具適應性和包容性的制度結構轉型,為構建技術時代下的公平勞動治理體系提供理論支援與實踐方案。
