Incidencia de los Derechos Humanos y los Derechos Económicos, Sociales y Culturales en los procesos latinoamericanos de integración

Abstract

Una tendencia actual a la hora de realizar acuerdos entre Estados mediante las figuras de procesos de integración o tratados de libre comercio, es considerar que el contenido de éstos no solo se limite a aspectos económicos o comerciales, sino que traten y debatan aspectos de seguridad, cooperación y compromisos, que trascienden hasta garantizar tanto el reconocimiento de los Derechos del Hombre, como el de los denominados Derechos Económicos, Sociales y Culturales en el ordenamiento jurídico de los estados participantes, amén de incluir cláusulas en que se obliguen a preceptuar mecanismos efectivos de control y protección de los mismos, constituyéndose, en consecuencia, en un mandato supranacional de intervención por parte de la comunidad internacional en la soberanía estatal bajo la premisa de apoyar eficientemente a las naciones más pobres y sus habitantes, frágiles en la protección de toda clase de derechos a favor del ser humano. El desarrollo de las iniciativas integracionistas en América Latina ha estado muy a la par, en términos de tiempo, al desarrollo de los Derechos Humanos, principalmente de los Derechos Económicos Sociales y Culturales (DESC); no obstante, los mecanismos y la institucionalidad de los esquemas de integración en esta región han sido insuficientes para una efectiva garantía y protección de esta clase de derechos en un ámbito supranacional. ****** Abstract A current trend among States when they negotiate new agreements seeking for an integration process or a free trade agreement, is to consider that the agreement’s contents are not limited to just economic or commercial issues but to also involve security aspects, cooperation and commitment in order to guarantee Human, Economic, Social and Cultural rights in the legal system of each State and also to include clauses that promote effective control and protection mechanisms of these Human Rights; it is in this way how they constitute themselves as a intervention supranational mandates of the International Community over State Sovereignty under the premise of supporting efficiently the poorest nations and their inhabitant, fragile people in the protection of any kind of Human Rights. The development of integration initiatives in Latin America has developped quite along with the development of Human Rights, mainly the Social and Cultural Rights (ESCR) however, the mechanisms and integration schemes in this region have been insufficient for effective security and protection of such rights on a supranational level.
