Influencia del pensamiento de rawls en la jurisprudencia de la Corte Constitucional colombiana

Abstract

El presente artículo de reflexión académica tiene como propósito presentar algunos elementos del pensa-miento de John Rawls que han sido tomados como parámetros de análisis ético y político en algunos casos resueltos por la Corte Constitucional Colombiana, en adelante CCC, en sus veinte anos de vida. La impor-tancia de este análisis radica en que al tener la CCC como función principal la salvaguarda de la supremacía constitucional, sus pronunciamientos tienen una autoridad tal que las demás instancias estatales toman como parámetro hermenéutico sus razonamientos y por contera, los autores que les sirven de basamento.
