Pleito pendiente internacional. Una mirada desde el comité de derechos humanos

Abstract

Este artículo aborda el elemento de admisibilidad convencional y reglamentario de “no pleito pendiente internacional”. A partir de una investigación básica, descriptiva y deductiva se obtiene el resultado de este análisis, el cual permite abordar tanto la pregunta ¿qué debe entenderse por pleito pendiente internacional?; y el objetivo general de identificar las líneas de argumentación del Comité cuando un Estado propone la inadmisibilidad de la comunicación por la existencia de un pleito pendiente. Como resultado se obtuvo que se está en presencia de pleito pendiente internacional cuando existe identidad entre los autores, los hechos y los derechos de las dos quejas internacionales, y, además, que estén siendo tramitadas al mismo tiempo ante órganos de naturaleza equivalente.
