La jurisdicción militar desde los fallos de la Corte Interamericana en relación con Colombia

Abstract

El artículo aborda tanto el problema cuál es la competencia y el alcance de la jurisdicción penal militar en Colombia como Estado Parte de la Convención Americana sobre Derechos Humanos, y el objetivo general de identificar los nichos citacionales que la Corte Interamericana de Derechos Humanos ha establecido en relación con la pregunta objeto de estudio. El resultado se consigue mediante el desarrollo de una investigación básica, descriptiva, deductiva y mediante la creación de una línea jurisprudencial, obteniendo que la jurisdicción militar tiene un alcance restrictivo y excepcional, y que su competencia se delimita sólo en juzgar a militares activos por la comisión de delitos o faltas que por su propia naturaleza atenten contra bienes jurídicos propios del orden militar.
