Evolución del régimen de regalías en Colombia a partir de la Constitución Política de 1991

Abstract

La explotación de los recursos naturales no renovables que son propiedad del Estado colombiano genera contraprestaciones económicas denominadas regalías y compensaciones. A partir de la expedición de la Constitución Política de 1991, el régimen de administración de los recursos provenientes de dicha fuente ha tenido una evolución bastante importante. El reciente Acto Legislativo 5 del 2011 introdujo normas que dan un giro de ciento ochenta grados al esquema existente. Con la reforma se busca mayor equidad en la distribución de la riqueza proveniente de la explotación de los recursos naturales no renovables y lograr que estos se conviertan en un motor que genere desarrollo sostenible para todas las regiones del país.
