La reforma constitucional de 1979

Abstract

“En este estudio se analizarán algunos de los puntos más sobresalientes de la Reforma Constitucional de 1979. Sin dejar de reconocer que todas las normas dentro de una Constitución, LEY DE LEYES, están íntimamente ligadas unas con otras para formar la cúspide de la pirámide Kelseniana, se considera por razones metodológicas mejor dividir el Acto Legislativo N°. 1 de 1979 en dos partes, más o menos disímiles: la Reforma al Congreso y la Reforma de la Justicia. Existen además algunos otros aspectos que de una u otra forma tocan con los anteriores, y que serán estudiados en la medida que se consideren de interés, tales como las reformas introducidas al régimen presidencial y aquellas que afectan el control constitucional. Inicialmente examinaremos las modificaciones que se introdujeron al Congreso, especialmente aquellas referentes a la planeación, al desarrollo regional, la autonomía presupuestal del Congreso, el artículo 120 'numeral 14 y las facultades extraordinarias.”
