Aproximaciones teóricas y metodológicas sobre las consecuencias de la sucesión en la distribución de la propiedad rural

Abstract

El presente trabajo indaga sobre las consecuencias de la sucesión en la distribución de la propiedad rural. Para lograr esto, se estima la tasa de fragmentación por sucesión, tomando como modelo la distribución de la propiedad rural del departamento de Cundinamarca, municipio de Topaipí y el municipio de Une. Los resultados muestran que la sucesión es un factor que perpetúa la alta desigualdad de la distribución de la propiedad rural en los casos analizados. También, se hace un recuento teórico sobre los fundamentos de la sucesión a lo largo de su existencia en el mundo jurídico romano-germánico, para evidenciar cómo esta institución tradicional de derecho sigue siendo tan importante en la actualidad por ser un mecanismo que redefine los derechos de propiedad en una sociedad de mercado.
