Criterios del Análisis Económico del Derecho aplicables al estudio de la patentabilidad de programas de computador

Abstract

Este trabajo tiene por objeto abordar, desde la metodología y preceptos teóricos del Análisis Económico del Derecho, la hipótesis de la patentabilidad de programas de ordenador, con el fin de anticiparse en términos de eficiencia o ineficiencia, al resultado de proteger la propiedad intelectual de este bien inmaterial bajo el régimen de patentes, a través de la observación de las interacciones entre los sujetos y tal hipótesis, que ya es funcional en algunos regímenes jurídicos.
